A Victorian company was fined $350,000 after a technician's failure to secure an automated gate led to a fatal workplace incident.
A recent Victorian County Court ruling has underscored the severe consequences of inadequate workplace safety protocols, resulting in a $350,000 fine for a company following a fatal incident at a client's premises.
The incident occurred when a company technician removed critical components from an automated gate system for repairs but failed to implement proper safety measures before leaving the site. This departure from standard safety procedures, which typically involved securing the gate mechanism, led to tragic consequences when a person was later crushed by the unsecured gate.
Judge Douglas Trapnell, presiding over the case in the Victorian County Court, emphasised that the technician's decision to rely solely on verbal instructions rather than physical safety measures represented a "fatal mistake." This deviation from previous practice, where the technician had consistently secured gates during maintenance, proved to be a critical error in judgment.
The case has drawn attention to employers' broader responsibilities under workplace safety regulations, particularly their duty of care not only to employees but also to "others" who might be affected by their work activities. Industry experts note that this ruling reinforces the principle that safety obligations extend beyond immediate employees to encompass clients, visitors, and members of the public who may interact with modified equipment or systems. "This tragic incident should serve as a warning to all duty holders that failing to protect workers and others who could be affected by their actions can have horrific consequences and result in hefty fines," stated WorkSafe acting health and safety executive director Adam Watson.
